News in the SCC Rules as of 1 January 2010

When the rules on an Emergency Arbitrator were adopted by the Stockholm Chamber of Commerce, a few amendments were also made to the SCC Rules. The new versions of the Arbitration Rules and the Rules for Expedited Arbitrations entered into force on 1 January 2010 and are called the 2010 SCC Rules.

Please note that English is the original drafting language of the rules.

The rules on an Emergency Arbitrator are found in Appendix II in the Arbitration Rules and the Rules for Expedited Arbitrations and the Schedule of Costs is found in Appendix III. As consequences of the adoption of the rules on an Emergency Arbitrator, Article 32 has been given a new paragraph 4, which by a reference incorporates the rules on an Emergency Arbitrator. The previous paragraph 4 is now paragraph 5. Another effect of the addition is that rules have a new Entry into Force rule that now can be found in the introduction of the rules. It is as previously the day when arbitration is commenced which determines which version of the rules that shall be applied. An addition has been made to the rule, stating that the rules are also applicable to applications for the appointment of an Emergency Arbitrator made on or after the day the rules enter into force.

The following additional amendments have been made to the SCC Rules

Amendments of the Arbitration Rules and the Rules for Expedited Arbitrations
Article 2 – The phrase”[a]rbitration is initiated by the Claimant filing” has been deleted in order to avoid overlapping Article 4;
Article 4 – new wording due to the amendment of Article 2; and
Article 9 – addition of new paragraph regarding decision on consolidation with reference to Article 11.

Amendments of the Arbitration Rules
Article 13 – the time given to the parties to jointly appoint an arbitrator is reduced from 30 days to 10 days
Article 14 – addition that the Confirmation of Acceptance of an arbitrator shall be sent not only to the parties but also to the other arbitrators.

In addition to the amendments mentioned above, some editorial amendments have been made which do not affect the substantive meaning of the rules.
