Swedish Arbitration Portal Updated: Court Considers Grounds for Default Judgment

The Stockholm District Court recently heard a case reviewing the arbitral tribunal’s competence in an international investment arbitration. The tribunal concluded that it had jurisdiction over the investor’s expropriation claim under a bilateral investment treaty. When the investor failed to appear at a preparatory hearing for the challenge, the state requested the court to grant a default judgment in its favour. The Stockholm District Court granted the state’s motion for a default judgment, finding that description presented by the state did not stand in contrast to what is commonly known and did not lack legal grounds. The claim also did not obviously lack a factual or legal basis.

The Swedish Arbitration Portal is a free service offered by the SCC to provide English translations of Swedish court decisions on arbitration issues. The site launched in May 2012 with the mission of increasing transparency in arbitration by making Swedish case law more accessible to the international community.
