The Pechersky District Court of Kyiv recently granted enforcement of an SCC arbitral award in a case between Remington Worldwide Limited (“Remington”) and the State of Ukraine.  &lt;br /&gt;
Remington had initiated arbitration against Ukraine, alleging violations of the Energy Charter Treaty (ECT).  The tribunal ultimately found that Ukraine violated one provision of the ECT and ordered Ukraine to compensate Remington.  Remington sought enforcement of this award through the Ukrainian courts.&lt;br /&gt;

The Stockholm District Court recently heard a case reviewing the arbitral tribunal’s competence in an international investment arbitration. The tribunal concluded that it had jurisdiction over the investor’s expropriation claim under a bilateral investment treaty. When the investor failed to appear at a preparatory hearing for the challenge, the state requested the court to grant a default judgment in its favour. The Stockholm District Court granted the state’s motion for a default judgment, finding that description presented by the state did not stand in contrast to what is commonly known and did not lack legal grounds. The claim also did not obviously lack a factual or legal basis.&lt;br /&gt;

Several arbitration awards have been compiled and published by the Arbitration Association for the South of Sweden (Sw. Skiljedomsföreningen i Södra Sverige). The awards were originally made public by party appeal to the Swedish courts. The database is in Swedish, but the awards are in the original languages and include both Swedish and English language awards. &lt;br /&gt;

Common trends in the application of Article 45(4) of the SCC Rules in SCC arbitrations have developed during the five years in which it has been possible to seek a separate award for reimbursement for Advance on Costs, concludes Gretta Walters in a new article. Walters has researched the applications made and found that tribunals granted requests for a separate award in 96 per cent of the cases and that the parties ultimately reported recovering money due to the award in 42 per cent of the cases.&lt;br /&gt;

The Supreme Court of Ukraine recently upheld enforcement of an SCC arbitral award. The dispute between Evertrade, a French company, and the Port of Kherson, a State entity, was resolved by a final arbitral award on 8 August 2008. Evertrade sought enforcement of the award in the Suvorovskiy District Court of Kherson in 2009, but the Port of Kherson challenged the enforcement in the Ukrainian courts for violations of the substantive law. The lower courts rejected the challenge.&lt;br /&gt;

Stockholm University has developed a unique &lt;a href="http://www.juridicum.su.se/jurweb/utbildning/kurser.asp?MomentID=2124&amp;Takt=100&amp;Frist=1&amp;Sida=Allmant&amp;Lang=eng" target="_blank"&gt;Master of Law programme in international commercial arbitration&lt;/a&gt;. This year, the university has admitted twenty-five new master students from nineteen countries in its arbitration programme. Coming from diverse backgrounds from the legal and business world, the new students have travelled from North America, South America, Asia, and across Europe to take part in the year long programme. &lt;br /&gt;

The new SCC Rules on an Emergency Arbitrator has attracted a lot of attention since they were introduced on 1 January 2010.&lt;/strong&gt; The SCC has therefore decided to release abstracts of the four Emergency Arbitrator cases received during the rules’ first year into force. The abstracts are included in an article, written Johan Lundstedt, SCC Legal Counsel, and reveal many interesting details of the cases such as the nationalities of the parties, the interim measures requested and the reasoning of the Emergency Arbitrators.

At the dinner, the "Honourable Man award" was awarded Donald Francis Donovan, Debevoise &amp;amp; Plimpton LLP in New York, and Klaus Reichert QC, Brick Court Chambers in London. The award is annual and will be given to a man "who not only share our goals but actively support them". A Russian company has challenged an Arbitral Award rendered in Stockholm. The company moved that the Arbitral Award be set aside since no valid contracts, nor an arbitration agreement, between the parties in the arbitration existed. The validity of the contracts was conditional upon the approval of the Board of Directors of both companies. An approval should have been submitted from the counter party, a Swedish company, in form of minutes from a board meeting. Such minutes did however not exist.

The first seminar, held on 31 May, was attended by over 90 participants, whose professional comments and questions turned the 4-hours event into a lively discussion of international arbitration. Stockholm as a seat of arbitration, party-counsel relationship, understanding of applicable law, efficient preparation for the hearing and evidence issues were in the focus of the questions-and-answers sessions which followed each of the three panels. &lt;br /&gt;

		&lt;p&gt;Figures from the first four months of 2010 demonstrate a stable SCC caseload, with numbers from January – April falling only slightly behind those of the record year of 2009, a year characterized by a 20 % growth. Statistics also show an equally strong international footprint in the SCC caseload, where international cases represent close to 50% of the new cases. Among pending cases before the SCC, however, international cases are in the majority. At present, there are 172 pending SCC cases, 62 % of which are international.&lt;/p&gt;

In November 2003 a company registered in the United States requested arbitration against a company wholly owned by the Russian State, pursuant to the SCC Rules. The claimant moved that the Arbitral Tribunal affirm that a contract between the parties was rescinded and that the respondent should pay certain damages. In the arbitral award, issued in June 2007, the Arbitral Tribunal dismissed all claims.

The Secretary General of the Arbitration Institute (SCC) as well as Vice President of the Stockholm Chamber of Commerce Ulf Franke will retire after 35 years of service. This Tuesday a half-day seminar followed by a reception was held in his honour. At the seminar Johan Gernandt, the Chairman of the SCC Board, announced that Ulf Franke will be appointed Honorary Secretary General at the SCC. A &lt;em&gt;liber amicorum&lt;/em&gt;, written by Swedish and international arbitration practitioners, was also presented to an astound Ulf Franke. &lt;br /&gt;

The SCC Secretary General Mr &lt;a href="http://www.sccinstitute.se/hem-3/sekretariatet-4.aspx" target="_blank"&gt;Ulf Franke &lt;/a&gt;has received a medal from the King of Sweden, Carl XVI Gustaf, for important work in international arbitration. Mr Franke has established the SCC as one of the most successful arbitral institutions worldwide. When Mr Franke arrived at the SCC it had only a few cases per year. Last year, however, the SCC received 215 new arbitration cases, setting a new record.
